Kanawha County prosecutor arrested for violating protection order

Posted: Updated:

Kanawha County prosecuting attorney Mark Plants was arrested on March 17 at about 9:42 p.m.

According to a criminal complaint, Allison Plants, Mark Plants' ex-wife, called a state trooper stating that her ex-husband was standing by her vehicle talking to their children outside of a Fruth Pharmacy in Charleston, WV.

An active domestic violence protective order states that Mark Plants is not to have contact with Allison Plants or two of their children.

Mark Plants said, "Last night I walked out of Fruth. My kids were unattended in a vehicle, it was dark. I stood with them until my ex-wife came back out. At this point that is the basis of the allegation. That is why I was arrested. I'm not going to answer or elaborate on any other questions"

Plants faces up to one year in jail or a $2,000 fine if found guilty of the violation.  Plants was released on a $2,000 personal recognizance bond.
