U.S. Attorney William J. Ihlenfeld II said Robert Fleming, 30, intended to harm the correctional officer in the June 2014 assault.

A Logan County, West Virginia resident was sentenced to five years' probation, with five months to be served in community confinement, for using identifying information for two family members to obtain credit cards.

Joseph Hurley, 28, of Man also must make $5,766 in restitution, the full amount of the carrier's loss, for the access device fraud.

U.S. Attorney Booth Goodwin said in January 2013 Hurley used the names and Social Security numbers of two relatives to obtain credit cards online from Citibank. He activated one of the cards and ran up $5,000-plus in charges in just six weeks, but the other was blocked by Citibank's Fraud Detection Unit because of suspected fraudulent activity. The first card was delivered to him by mail at the home in Man where he was living.

Hurley's case was investigated by the U.S. Secret Service and the U.S. Postal Inspection Service, with Assistant U.S. Attorney Erik S. Goes handling the prosecution.
